let start with the guilty plea. this came as a bit of a surprise many this morning. >> his guilt wasn't a surprise. but he was looking like he was going to contest these charges and the fireworks was him cross examining the witnesses, the people on the plane the people that stopped him from detonating his explosives. he wasn't going to be able to prove he didn't do it but we were expecting arguments or heated discussions. the defendant did plead guilty. >> let's turn to the terrorism case in iran. the suspect in custody right now. officials in iran, the accusation is that the officials they were trying to assassinate the ambassador of saudi arabia to this country. also the embassies in washington, d.c. what's the latest on this case? >> well, look what we know right now is that there was money involved. there was $100,000 wired to a

bank here in new york. there wasn't any explosives here. that's important to understand. the explosives was supposed to be something that the mexican drug cartel was supposed to come up with. that is reassuring. >> how close does it look like they got? >> they got close enough that there was $100,000 wired to a bank in new york. i can't understate the importance of that. if you have no bomb or money. this was something that -- somebody i in iran wanted this to happen. the question is who was it and were they doing it with the knowledge and say so of senior leaders in the government there. >> iran has said we had nothing to do with this and we resent the implication. the first thing a lot of iran watchers are saying this is a plot that sounds like something out of a movie. >> it sounds crazy.

a lot of people are looking at this and saying that the force is effective. the iranian revolutionary guard corps they are the a-team and not the b team. why would they outsource this so to a mexican drug cartel. but the justice department does not file charges like this unless they have a reason to believe that something like this is going on. we'll have to see what the evidence is but stranger things have happened. >> what are the president's options now? this is something we have been through before with i ran. what is the white house left to do? >> we have sanctions on them. we have already taken stern diplomatic efforts. we can launch an attack on iran but that does not solve the problem. right now i think what you are going to see is efforts to step up pressure in iran in the security council and the united nations with u.s. diplomats going to russia and china saying

we know you are reluctant to step up pressure but now we are talking about plots targeting foreign diplomats and saudi diplomats. >> using it as justification. >> china depends on saudi oil. they may have arguments with u.s. foreign policy but they don't want to mess with the saudis. maybe we'll start to see progress in that area. maybe. >> thank you, sir. >> thank you very much. turning to politics now, mitt romney held up under fire as rivals piled on the republican front runner in the g.o.p. debate. rick perry seeming to fade after everyone took aim at herman cain and that three-number plan. >> my top priority is 9-9-9. jobs, jobs, jobs. >> when you take the 9-9-9 plan and you turn it up side down i think the devil's in the details.

>> how many people are here for a sales tax in new hampshire? raise your hand. that is how many votes you will get in new hampshire. >> cain tried to turn the tables on romney. >> can you name all 59 points in your 160-page plan? >> but mitt romney had the confidence of a shoe in. >> you want someone who is smart and knows how the financial services works and how to protect american jobs. and i do. i've done it. >> he went into the debate with a major endorsement. >> tex governor rick perry tried to attack romney on health care. >> romney care has driven the cost of small business insurance premiums up by 14% over the national average in massachusetts. >> we have less than 1% of our kids that are uninsured. you have a million kids in texas.

>> no serious mistakes for the texas governor but not many details either. >> i will not lay it out for you tonight. myth's had six years to be working on a plan. i have been in this eight weeks. >> i thought that was a killer. >> i agree with that. it just said i define myself as being unqualified to be in this race. >> let's bring in mark murray, nbc deputy political director. mitt romney a strong endorsement from christie and strong poll numbers. is this thing inevitable? >> there are two ways to look at it. there are signs pointing to the fact that romney is the person to beat for the republican nomination. you mentioned the chris christie's endorsement. the strong debate performance evans. other endorsements. but when you look inside the numbers this race isn't over just yet. remember that iowa, nbc poll

that showed that cain and mitt romney running neck and neck with cain doing well among tea party types. there is evidence that romney has yet to win over the tea party voters. when you look at the national polls adding up the cain, balk how much, perry vote against what romney is getting that shows there is a sizable portion of the vote if it coalesces around one person could be dangerous for romney. >> let's talk about rick perry now. he spoke at a frat house after the debate and he said i just try to get up every day and do my job. debates are not my strong suit. is rick perry going to be able to sing that same tune over the next -- i think we've got a dozen more debates. >> what these debates have done, republican voters are trying to find someone they want at that debate stage with obama in

september or october of 2012 and so far what they've seen from his performances against the other republicans they really don't like. now in fairness to governor perry he got at this late. mitt romney has been running for president for five ore six years and other republicans debating well before perry got into the race but he has yet to have a moment where he has made republican primary voters confident that this guy could go toe to toe be in a debate with president obama. we saw president obama in debates in the primary season and excelling in the general election. >> are we at the point yet where someone drops out of this thing? if so who might be the first to go? >> i don't think we will see anyone drop out until the contests. we have about less less than three months before iowa and new hampshire. if you are the rick santorums of the world you might as well stay in.

as long as they have money to keep campaigning and attend the debates they will stay in the race. >> mark, thank you. >> thanks. to the syndicated panel -- to the panel i should say. tony and julian epstein. thank you for joining me this afternoon. just a few weeks ago, rick perry g.o.p. darling now people are thankful if he doesn't mess up too much. can rick perry turn this thing around? i'll start with you, tony. >> i don't think so. his campaign is creative and a matter of time. i don't think $17 million fundraising which is impressive in 49 days can help him. he slept through another debate. i think he's a goner. i think the more interesting question is romney's firing on all cylinders and performing very well. the question is can you take on a traditional campaign that is

well funded and well organized such as romney organized by cain who don't have the money and organization. it's an open question. huckaby won iowa in '08. maybe things are changing. >> julian, tony mentioned media there do you think that the tv ad campaign that rick perry is set to launch here shortly, do you think that is going to in any way dent romney's armor? >> maybe in some states. but i think the debates have shown that perry used his texas expression is all hat and no cattle. what is going on the republican side is it the establishment of candidate versus an undefined movement or activist candidates. the republican voters flirted with michele bachman and didn't like her. then dated rick perry.

now they are dating herman cain. my suspicion that will go on for a couple weeks as well. the keyword was inevitableibilty. mitt romney mixed up chris christie's endorsement yesterday. he won points in the debate. and the interesting thing was that romney moved to the center on two critical issues on the tarp bailout and on health care. he defended the tarp bailout and the massachusetts plan. and he wasn't attacked by the other republicans. rick perry was asleep for most of the debate. i think republican voters are trying to decide between the -- >> lest talk -- let's talk about. what were you about to say tony? >> i agree with that largely now. but i don't know that it is just activists. cain is clearly the most appealing and most straight

forward. newt is offering -- >> appealing and straight forward yes but folks -- when they look at that 9-9-9 plan. >> i think those of us who are washington professionals look askance at that. but in 19802 the republican professionals looked askance at reagan. i'm not equating anyone to reagan. but the fact is that we in washington sometimes misjudge what we judge to be nonprofessionalism how that will appeal to the public. i don't discount the possibility that unlikely candidates may catch on yet. >> we have seen a consistent pattern with these movement candidates. it is the establishment versus the movement dynamic. the republican primary voters are enamored with michele bachman and then with rick

perry. and i think the same thing will happen with herman cain. he is the most likable candidate and people have laid off him because he is likable. but anyone looking at this nine nine plan looks at it as gimmicky. >> but the voters are not all serious economists and a straight forward explanation beats a -- >> that's going to -- >> they want a serious candidate. >> we have to leave it there now. i'm sure this is not the last time we will talk about the nine nine plan here. the jobs bill. the president is chris crossing the country may be trying to sell what is dead. the senate voted not to continue debate on the 447 billion dollars job package. the question now is what is next? kelly o'donnell is joining us.

good afternoon to you. first is the jobs bill as it is now constructed is it officially dead in. >> even the white house will acknowledge it is going nowhere that the death nail was put in it last night when the senate had most democrats but all and couldn't get tot the next phase. there is a plan b. the way the president laid it out with many parts to it, a total price tag in the $450 billion range. now the democrats in the senate will try to break out certain pieces one policy at a time. and republicans will get bind that as well by breaking it down and debating specific parts there can be areas like the payroll tax and perhaps changes in regulation or taxes or there would be common ground in changing taxes not raising them but changing the formula. now it is many plans not just one. >> what about the infrastructure

the occupy wall street demonstrations have moved from the back page to the front page now and the question no longer is whether they will make an impact but what kind of an impact on the democratic party and 2012. joining me is former plash secretary robert riech. good afternoon to you. >> the occupy wall street protests movement won't take hold of the democrats like the tea party did the republicans. why not? >> basically because the democrats have been drinking at the same trough. that is wall street campaign donations as the republicans have been drinking. now the democrats might actually change their tune. if this demonstration and

movement becomes large enough, democrats might actually say look we are not going to be dependent on wall street any more. we are not going to be dependent on the rich. we will be a grass roots organization. >> you have been a democrat far long time. is there any chance of that happening? >> i have been a democrat long enough and around politics long enough that we don't know the future. there are spontaneous movements that happen. the civil rights movement i was involved in and the anti-vietnam movement. things happen that people don't predict. americans get so upset and frustrated and angry by obvious sort of imbalances in our society. you have the top 1% of americans taking home 20% of total income right now. the top 1% owning 35% of america. i mean things get so out of

balance that sometimes people say we are not going to take this any more. we want to take back american politics. >> do you think from is a short term political effect that this movement has? do you think from will be a long term political effect as well? >> in the short term i think that vote yesterday in congress where there were two democrats going along with every republican in burying the president's new jobs plan it wasn't a good sign. i mean it is certainly a sign that this occupy wall street and occupy wall street in many cities has not yet really affected the voting in washington. but nothing good happens in washington. i know this far fact because i have been there. regardless of how good the people are nothing good happens in washington unless people outside washington are mobilized and organized to make sure that

good things happen in washington. >> one of the knocks on this movement is that they haven't had specific demands. that the people who are in the streets haven't had a list of things that they want from lawmakers. do you think that is something that this movement desperately needs not just to gain legitimacy but to affect political change? >> phase one of most movements are just a lot of people expressing a lot of discouragement and they march and come together. phase two. and we don't know when phase two will start if there will be one is there is a kind of coalescing around issues around particular demands and phase three is you know political action organized disciplined political action. i don't know whether -- and we don't know whether this particular takeover is going to get to phase two or phase three. it may.

budget cuts are forcing topeka, kansas to decriminalize domestic violence. the city council voted to repeal the law after voting who should pay for the misdemeanor cases. the move forces the state to prosecutor pretty the cases. they would remain a crime under state law and it will make the victims of domestic violence safer in the long run. pennsylvania's capital city filed for bankruptcy now after

the harrisburg city council voted in favor for bankruptcy 4-3. they are facing problems due in part to an energy incinerator that does not generate enough revenue. its debt is $458 million. it's not a cry for help you get after day. massachusetts police got a call from a couple in a local farm who were lost in a corn maze and needed help getting out. >> i'm still stuck at conners farms. i don't see anybody. i'm really scared. it's really dark and we have a three-week-old baby with us. >> a police officer is on the way. >> they managed to get out. the farm owners say it takes about an hour for people to find their way out of the maze. video of baby lisa's mother

that really debate performance in orlando, florida. the perry folks want to talk about mitt romney has been in this race for -- he has been running for president for five or six years. we have been in it eight weeks. we are working on the debate aspect. but the americans are looking for a commander-in-chief not a debater in chief. one thing they want to do is change the focus from the performance last night to the jobs roll out that perry is going to do. he is unveiling an economic plan. he has speech in pittsburgh on friday morning. they want to put this behind them and move on to their own solutions or solutions for unemployment and the jobs issue. >> we have heard a lot about the perry campaign making some adjustments. we have heard about rehearsals and debate practices. people standing in as mitt romney. how is the campaign squaring

their renewed focus on debate prep with the performance last night? >> the for mat last night was different. they were seated around the table and just the focus on economics and jobs which should have been a good topic for rick perry. his premise is job creation as texas governor. the subject matter he didn't get tough questions on immigration and in-state tuition, the issues that are problematic in the past. it has to be hard that it is getting panned by the media today. >> he had a flub telling that frat boys that the american revolution was in the 1760s. >> he went to a fraternity house on dartmouth campus. but he took some questions from the students and showed a lot more energy and didn't have the

lethargic performance from the debate a few minutes before. he was engaged with the student. but this line came out of his mouth. he was answering a question about states' rights and mixed up the century of the american revolution. it was a sign of how tired he has been. >> thank you. by all accounts mitt romney fared much better than governor perry did last night. carrot haake joining me now. a big day with the endorsement and the debate. >> no kidding. they had a big day. i'm at an ann romney event right now. she was singing his praises from the performance last night. the christie announcement in the middle of the day gave them momentum. romney couldn't resist name

dropping him during the debate. i think we have some tape. take a listen. >> one of the problems with obama care is he doesn't deal with people without insurance but takes over health care for everyone. chris christie says he spends a trillion dollars and raises taxes. >> not an issue that chris christie is closely soernted with. >> you have been with the campaign for a long time now. is the shift in mood palpable. is there a difference between now and two weeks ago? >> camp romney in the sense that you can talk about it, these guys have been disciplined and confident but they were in a good mood last night. they feel a sense of momentum. you are going to see more of taking the message to different places. they are going back to iowa last week. they have not been there since the straw poll.

they will be pushing their message in the next couple weeks. >> it will be interesting to see with the endorsement with from chris christie. will the be interesting to see how that helps mitt romney win over the conservatives that have been by many accounts elusive to him. >> that's right. in talking with some of romney's advisors they really feel like christie is someone who can help them with the fiscal conservative crowd. christie has a reputation as a reformer. they think that is an area they can use him. you see this going back to iowa they are not going to let the hard-core conservative vote fall by the wayside. >> garrett haake on the road with the romney campaign. a new twist in the case of a missing 10-month-old baby girl. we have video showing the baby's mother hours before lisa irwin

vanished. peter alexander has the latest from kansas city. >> reporter: that video shows debra bradley, lisa irwin's mom and an unidentified man going into a grocery store on monday according to the videotape. and it shows the two of them at the grocery store picking up boxed wine, baby food and baby wipes before leaving. we were trying to find out who that man is. we understand from depp are's father that she does not have a driver's license and he suspects that individual who may have been a neighbor or a family friend was likely there simply to drive her to the location. we are hearing from bill stanton a private investigator brought in by the irwin family. i spoke to him last night. he says he has not been hired by the irwin family but paid by a

a quarter of americans say they lose respect for people when they find out they are smokers. a recent poll shows there is more bias towards smoker than 20 years ago when 15% of people said that held people who smoke in lower regard. day 1 of the involuntary manslaughter trial of michael jackson's personal physician got under way an hour ago. on the stand right now the cardiologist who is testifying about his review of dr. conrad murray's conduct calling it gross negligence for giving michael jackson propofol at his home. tuesday jurors heard more of the

police interview. >> and she asked me, dr. murray, you said you save a lot of patients. you know, you save people with heart attacks and you couldn't save my dad. i will quake up in the morning and won't be 5th able to see my dad. >> joining me, ricky -- showing autopsy photos of jackson's naked body. what is gained by that? >> i don't know that there is anything gained by it in terms of this emotional punch because they have the emotion. but there is an important point here, craig and that is the point of looking at the frailty of michael jackson when the prosecution says there is no way and dr. rogers said yesterday it is unreasonable or less reasonable to think that michael

jackson had been given lorazepam, that michael jackson had been given propofol and that somehow by some means when dr. murray left the room he went and got it on his own. >> another strong point, l.a.'s deputy medical examiner called the thought that he injected himself was unreasonable. take a listen. >> let's assume self administration of prop toll. under those facts where dr. murray leaves his patient with the -- apparently the drugs accessible and no monitoring equipment accessible would you deem it a homicide? >> yes. >> what more does the prosecution need to do here? >> well the prosecution is being smart. they are saying that this is a homicide, that this is the cause of death and now, the witness on the stand, craig whom i have been watching all the way from

london where all these people are watching. they are glued to watching michael jackson's death trial from dr. conrad murray. with the witness on the stand is the next expert and dr. steinberg is talking about gross negligence from the point of view of a cardiologist. the prosecution will clean it up by dealing with a person who is a pull mon neighbor expert and then we will have the final question and answer again an expert witness. the prosecution will wrap it up on the science. >> day 11, the prosecution to this point and you and i have talked about this their case has been pretty solid. what is the defense going to have to do when it presents its case to present even a modicum of reasonable doubt? >> well the defense has to use expert witnesses because they are not going to have dr. conrad murray testify say aye because

he has testified through a statement that was tape recorded. unless they have a mega expert and they claim they do. that at that point what we're going to see is a defense expert saying even with all of the things that dr. murray did, even if it's grossly deviant from the standard of care that ultimately it did not cause michael jackson's death. that is a mighty expert, indeed, craig. >> and again you don't think that there is any chance that dr. conrad murray takes the stand? >> not if i represented him. >> rikki klieman from london this evening. side bar now, the beau of one of the sitcoms of modern family may be considering a run for the senate.

reject the most is the jobs part of the jobs bill. and they continue to perpetuate a falsehood that the last jobs program didn't create any jobs. say they say the stimulus bill the last time didn't create jobs. absolutely wrong. untrue. created about 2 to 3 million jobs. >> but speaking about this plan, specific components of the president's jobs bill, what parts of that plan do you think can pass? >> we'll see. probably the tax cuts. the republicans like tax cuts although not for middle income people. they like them better for rich people. but the payroll tax holiday and tax cuts for small businesses. but i hope the president is talking about the whole bill. i want to push for the whole thing and take tot the american people. >> but you are familiar with the mood there in washington.

i mean, political feasibility here do you think there is a remote chance that that bill passes in its current form? >> well i don't know. the president has said that we are just going to keep pushing. we're going to take part by part. but i hope that does include the part that actually puts people to work. you know, he wants to put youth and infrastructure jobs in line and i hope that we do that. >> let's talk about your proposal now. explain how howe the fairness in taxation act would work. >> we tax millionaires and billionaires more starting at a million dollars in income every year they would pay 45%. it ratchets up to a billion a year to a 49% tax rate although that is lower than the high tax rate in the reagan administration. >> wasn't the president's jobs bill, the procedure vote that happened last night in the senate wasn't that bill defeated

in part because there aren't the votes to raise taxes in this country right now? >> i, again, part by part, 81% of americans i saw last night support i think -- it was on msnbc, support the idea of taxing millionaires and billionaires. this is wildly popular not because people are mad at rich people but it is fair. they want a fair tax system. and so you know i think it's at the peril of the republicans to reject that notion. >> we have talked about those polls here on this station and read about them as well. the mood in the country to support something like that they say they do. why hasn't that translated into action on capitol hill? what do you think the reason is behind that? >> i don't know if the republicans to go home on the weekend if they go to the grocery store or if they go to school events with their children because i hear it
